What is Design ?

Under Section 2(d) of the Designs Act, 2000, a “design” refers to:

Features of shape, pattern, configuration, composition, or ornamentation of lines or colours applied to any article whether two-dimensional, three-dimensional, or both by any industrial process or means, which in the finished article appeal to and are judged solely by the eye.

However, the following are excluded:

  • Principles or methods of construction
  • Mechanical devices
  • Trademarks, property marks, or artistic works

Essentials for Design Registration

For a design to be registrable under the Act, the following conditions must be satisfied:

  • Novelty & Originality – The design must be new and not previously published or used anywhere in the world prior to the application date.
  • Visual Appeal – Protection applies only to features visible to the eye.
  • Application to an Article – The design must be capable of being applied to a physical article.
  • Non-Functional Nature – Functional or mechanical aspects are not protected.
  • Distinctiveness – The design must be significantly distinguishable from existing registered designs.
  • Exclusion of Artistic/Trademark Elements – Pure artistic works or trademarks are not registrable as designs.

Authorities for Filing Design Applications

Design applications may be filed at the following Patent Office locations:

  • Controller of Designs – Kolkata (Head Office)
  • Patent Office - Delhi
  • Patent Office - Mumbai
  • Patent Office - Chennai
  • Patent Office - Ahmedabad

Applications filed at branch offices are processed through the Head Office at Kolkata.

Process for Design Registration

a. Filing of Application (Form-1)

The application must be filed along with prescribed fees and the following particulars:

  • Name, address, and nationality of the applicant
  • Legal status & place of incorporation (for companies/entities)
  • Article name to which design is applied
  • Locarno Classification (Class & Sub-Class)

b. Representation of Design

  • 2D Designs: Two copies required
  • 3D Designs: Views from front, back, top, bottom, and both sides

The applicant must clearly highlight the novel features distinguishing the design.

c. Separate Applications

If registration is sought in multiple classes, separate applications must be filed for each class.

d. Statement of Novelty / Disclaimer

A statement specifying novelty must accompany representations, particularly disclaiming mechanical processes, trademarks, letters, or numbers. It must be signed and dated by the applicant or authorized agent.

e. Examination by Patent Office

The Controller examines the application and may raise objections. Upon compliance and rectification, the design proceeds to registration.

f. Grant of Registration

Once approved, the Design Office issues a Design Registration Certificate, granting statutory protection.

Validity & Renewal of Design Registration

  • Initial validity: 10 years from the date of registration
  • Extension: Additional 5 years

Renewal must be filed through Form-3 along with the prescribed government fee (₹2,000) before expiry of the initial term.


Documents Required for Design Registration

To file an application for Design Registration under the Designs Act, 2000, the applicant must submit the prescribed form along with supporting documents and design representations.

Basic Documents & Details

1. Applicant Details

  • Name, Address & Nationality
  • Legal Status (Individual / Company / LLP / Firm, etc.)
  • Place of Incorporation (for entities)

2. Representation of the Design

  • Clear graphical representation of the design
  • 2D Designs: Two copies
  • 3D Designs: Views from front, back, top, bottom, left & right sides
  • Images/drawings must clearly highlight the novel features

3. Name of Article

  • The specific article/product to which the design is applied

4. Class & Sub-Class

  • As per Locarno Classification of industrial designs

5. Statement of Novelty / Disclaimer

  • Declaration specifying the unique features of the design
  • Disclaimer regarding mechanical parts, trademarks, letters, numbers, etc.

6. Power of Attorney

  • Authorization in favour of the Patent/Design Agent (if filed through an agent)

7. Priority Document (if applicable)

  • Required where priority is claimed from a convention country application
